Colorado Adoption LawColorado permits single GLBT people to adopt and does not explicitly prohibit same-sex couples from adopting. A 2007 law provides that a child may be adopted by a second adult parent upon the written consent of a single parent if the child has no other legal parent.Colorado Birth Certificate Law: Gender Identity IssuesColorado permits post-operative transsexuals to amend their sex on their birth certificates. Colorado Custody and Visitation LawCourts typically will not consider a parent’s sexual orientation or gender identity in custody and visitation determinations unless it is shown to adversely affect or harm the children. Courts will allow a former same-sex partner (with no legal or biological relationship to the children) to petition for parental responsibilities. Colorado Donor Insemination LawColorado law permits unmarried women to undergo donor insemination. Colorado Hate Crimes LawState law covers hate crimes based on gender identity and sexual orientation. Colorado Marriage/Relationship Recognition LawColorado law and the state constitution both purport to ban recognition of marriages between same-sex couples. There are no other forms of relationship recognition for same-sex couples in state law or policies. Colorado Non-Discrimination LawColorado law protects against discrimination based on sexual orientation and gender identity. Colorado School LawColorado law does not address school issues relating to sexual orientation or gender identity. Colorado Sodomy LawThe Colorado sodomy law was repealed in 1972. Colorado Surrogacy LawThere is no provision on surrogacy in Colorado state law. There are no provisions in Colorado law or reported or published cases dealing with the issue of surrogacy.
